1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity, "Client" or "User") and TrustWaiver AI ("Company," "we," "us," or "our"), governing your access to and use of https://trustwaiver.io and associated compliance auditing services.
By accessing the Platform or initiating a subscription, you agree that you have read, understood, and agree to be bound by all of these Terms.
2. SaaS Description & Compliance Disclaimer
TrustWaiver provides automated construction compliance workflow automation, multi-modal OCR extraction for ACORD 25 certificates of insurance, and statutory lien waiver e-signature collection.
Legal Disclaimer: TrustWaiver AI is a software technology provider, not a law firm or insurance brokerage. While our platform enforces state-mandated statutory waiver formatting and flags policy limit mismatches, users should consult qualified construction legal counsel and licensed insurance brokers for specific contractual disputes.
3. Free Trials & Subscriptions
- 14-Day Free Pilot: Subscriptions include a 14-day free trial. Your card is billed $0.00 at signup. Unless cancelled before the 14-day period concludes, your subscription automatically renews at your chosen tier.
- Billing Cycle: Subscriptions are billed monthly in advance via Stripe.
- Cancellation: You may cancel your subscription at any time via your billing portal or by emailing support@trustwaiver.io. Access remains active until the end of your billing cycle.
4. Electronic Signatures (ESIGN & UETA Compliance)
TrustWaiver complies with the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA). Signatures executed by subcontractors on digital lien waivers are legally binding with complete timestamp, IP address, and identity audit logs.
5. QuickBooks & Third-Party Services
When utilizing QuickBooks Online or ERP sync features, you authorize TrustWaiver to read active vendor lists and modify bill payment hold notes. You represent that you have administrative rights to link your organization's accounting workspace.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall TrustWaiver AI be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the service.
7. Governing Law & Contact
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States.
